These Terms of Service ("Terms") govern your use of Hot4Shirts websites, tools, services, and checkout flows, including AI prompt and design generation features (collectively, the "Services"). By using the Services, you agree to these Terms.
You represent that you are legally able to enter into a binding agreement. You are responsible for all activity submitted through your device, account, session, or checkout flow.
You may submit prompts, text, artwork, logos, photos, and other material ("User Inputs"). You represent and warrant that you have all rights needed to submit User Inputs and that your User Inputs do not infringe any third-party rights, violate any law, or include prohibited content.
To the fullest extent permitted by law, you agree that all AI-generated images, derivatives, and related marketplace assets generated from prompts submitted through Hot4Shirts Services ("Generated Assets") are created for Hot4Shirts as commissioned works and are intended to be owned and controlled by Hot4Shirts.
If any Generated Asset is not legally treated as a commissioned work or ownership does not automatically vest in Hot4Shirts, you hereby irrevocably assign to Hot4Shirts all worldwide right, title, and interest (including all intellectual property and exploitation rights) in and to such Generated Assets.
You further grant Hot4Shirts a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, sell, resell, and otherwise commercially exploit User Inputs and Generated Assets in any media and channel, including marketplace listings, print-on-demand products, marketing, and promotions.
Unless otherwise stated in writing, customers purchasing a digital design license or printed product receive a limited, non-exclusive, non-transferable license to use the purchased output for personal or internal business use. Resale, redistribution, sublicensing, or standalone transfer of digital files is prohibited unless expressly authorized in writing by Hot4Shirts.
You may not submit content that is unlawful, infringing, defamatory, hateful, violent, obscene, deceptive, or otherwise prohibited by law or platform policy. Hot4Shirts may remove, refuse, or disable any submission at its sole discretion.
Prices, shipping, taxes, and product availability may change at any time. Orders are not final until accepted and paid. We may cancel, limit, or refuse orders where permitted by law.
Preview images may include watermarking and other protection measures. Removing or circumventing watermarking or technical protection is prohibited.
Services are provided "as is" and "as available" without warranties of any kind except where required by law. To the maximum extent permitted by law, Hot4Shirts is not liable for indirect, incidental, consequential, or special damages arising from use of the Services.
You agree to defend, indemnify, and hold harmless Hot4Shirts and its affiliates from claims, damages, losses, liabilities, and costs arising out of your User Inputs, Generated Assets based on your prompts, your breach of these Terms, or your misuse of the Services.
We may update these Terms from time to time. Updated Terms are effective when posted. Continued use of the Services means you accept the updated Terms.
